Instructions following a meeting of the Council for Сivil Society and Human Rights

Vladimir Putin endorsed a list of instructions following the meeting of the Council for Civil Society and Human Rights on December 7, 2022.

The Presidential Executive Office was instructed to review ways of improving public oversight mechanisms in the election process in cooperation with the Central Election Commission and the Commissioner for Human Rights of the Russian Federation.

Instructions to the Government of the Russian Federation concern the institution of turnover based fines for companies that allow leaks of personal information, and the introduction of relevant amendments to the legislation.

The Government was also instructed to discuss ways of developing the production of prostheses, spare parts for them and source materials used for their manufacture with a view to providing people with amputated limbs with these medical devices, including those wounded during the special military operation.

In addition, the Government was instructed to take measures to meet the needs of the healthcare systems in the Donetsk People’s Republic, the Lugansk People’s Republic, the Zaporozhye and Kherson regions for medications and medical devices required for preventing, diagnosing and treating infectious diseases.

The Government, along with the Defence Ministry, was instructed to determine the need for medications and medical devices, including bandaging materials, for rendering medical aid to the wounded in the special military operation and to take additional measures to meet the need.

Instructions to the Government, along with the Presidential Executive Office, the Russian Academy of Sciences and the Russian Historical Society, and with the participation of leading universities and research organisations, concern the drafting of textbooks and study aids, which are included in the federal list of instructional materials for History and Social Studies.

Instructions to the Government, along with the Bank of Russia, concern the creation of a mechanism for the payment by banks and other lending organisations of compensation to clients whose money was lost due to fraudulent activities, and the introduction of relevant legislative amendments, if necessary.

The Government of the Russian Federation, along with regional executive government bodies, was instructed to establish a special centre responsible for the provision of medications, rehabilitation and socialisation, including training and retraining of participants in the special military operation whose health was impaired as a result, and also to create a system of targeted support for participants in the special military operation and their family members.

Instructions to the Government of the Russian Federation, along with executive government bodies of the Donetsk People’s Republic, the Lugansk People’s Republic, and the Zaporozhye and Kherson regions, concern payment of compensation for housing that was lost or damaged during hostilities in the said regions of the Russian Federation.

Instructions to the Government of the Russian Federation, along with executive government bodies of the Belgorod, Bryansk, Kursk and Rostov regions, concern restoration of housing located on the territories of the said regions that was lost in the shelling of the armed units of Ukraine and acts of terror.

Instructions to the Government of the Russian Federation, along with the Supreme Court, the Council for Civil Society and Human Rights, the Commissioner for Human Rights, and the Commissioner for Children’s Rights, concern the introduction of legislative amendments enhancing the right to defence for citizens taking part in court cases on restoring their legal capacity (abolishing restrictions on their legal capacity).

Instruction to the Defence Ministry, along with the Health Ministry and executive government bodies of the Donetsk People’s Republic, the Lugansk People’s Republic, and the Zaporozhye and Kherson regions, concern exemption from military duty of prosthetists, orthopedists, and doctors of other specialities that were called up for military service in the Armed Forces of the Russian Federation during mobilisation.

Instructions to the Ministry of Justice, along with the Ministry of Economic Development and the Civic Chamber of the Russian Federation concern improvement of legal regulation of the activities of non-profit organisations and introduction of relevant amendments to the legislation, as well as an opportunity to expel individuals and legal entities from the founders of non-profit organisations at the initiative of the management of the said organisations.

The Ministry of the Interior of the Russian Federation, along with the Prosecutor-General’s Office, the Investigative Committee and the Federal Penal Service, was instructed to take measures to prevent the use of Azhur special mobility restraints on women, minors and persons suspected and accused of committing non-violent crimes.

Instructions to the Prosecutor-General’s Office, along with the Investigative Committee and the Ministry of the Interior concern the involvement of law-enforcement veterans as mentors for sharing their experience related to the functioning of the newly-created units of law-enforcement bodies in the Donetsk People’s Republic, the Lugansk People’s Republic, and the Zaporozhye and Kherson regions.

The Prosecutor-General’s Office, along with the Investigative Committee, the Federal Security Service, the Ministry of the Interior and the Supreme Court were instructed to take measures to annul the legal consequences of politically motivated criminal prosecutions of citizens of the Donetsk People’s Republic, the Lugansk People’s Republic, and the Zaporozhye and Kherson regions for violations of the criminal law of Ukraine.

Instructions to the Prosecutor-General’s Office, along with the Investigative Committee, the Ministry of the Interior and the Supreme Court concern the need to monitor legal and justified deadlines for investigating criminal cases.

The Investigative Committee, along with the Council for Civil Society and Human Rights, the Commissioner for Human Rights and the Public Chamber of the Russian Federation, was instructed to make a legal assessment of the unlawful persecution of public figures, journalists and human rights activists in Ukraine and of the violations of their rights and freedoms.

Recommendations to the Supreme Court, along with the Prosecutor-General’s Office, the Investigative Committee of the Russian Federation, the Ministry of the Interior, the Ministry of Justice, the Federal Penal Service and the Public Chamber of Russia concern an analysis of the practice of the detention of people accused of non-violent crimes, including people with illnesses and women with minor children, and the need to introduce legislative amendments to humanise the justice system whenever necessary.

The State Duma, along with the Prosecutor-General’s Office and the Investigative Committee were advised to review the proposals of the Presidential Council for Civil Society and Human Rights to introduce criminal liability for inciting discrimination or discriminatory acts as regards citizens of the Russian Federation living abroad and compatriots, and, if necessary, to ensure the introduction of relevant amendments to Russian legislation.
