Law ratifying Protocol No. 15 amending the Convention for the Protection of Human Rights and Fundamental Freedoms

Vladimir Putin signed Federal Law On Ratification of Protocol No. 15 amending the Convention for the Protection of Human Rights and Fundamental Freedoms.

The Russian Federation signed the Protocol in Strasbourg on September 19, 2016.

The Protocol introduces to the preamble to the Convention a reference to the European Court of Human Rights’ (ECHR) subsidiarity with regard to national courts and underscores the existence of participant states’ margin of appreciation in implementing the Convention at the national level.

The Protocol ends the rule that ECHR judges have to step down upon turning 70. This enables highly qualified judges to remain in their post longer than is currently possible. The Protocol also ends the rule regarding the right of participant states to object to ECHR chamber’s proposals to relinquish jurisdiction in favour of the ECHR Grand Chamber.

The Protocol reduces the deadline for making applications to the ECHR from six months to four months.
