Executive Order on the specifics of legal regulation for the use of nuclear energy in the Zaporozhye Region

The President signed the Executive Order On the Specifics of Legal Regulation for the Use of Nuclear Energy in the Zaporozhye Region.

In accordance with Article 31 Paragraph 2 of Federal Constitutional Law No. 7-FKZ of October 4, 2022 On the Accession of the Zaporozhye Region to the Russian Federation and the Establishment of a New Constituent Entity of the Russian Federation, Zaporozhye Region, the President decided to give the joint-stock company, the Operating Organisation of the Zaporozhye NPP, the status of a nuclear energy operating organisation to operate and/or discontinue the operation of nuclear power facilities at the Zaporozhye Nuclear Power Plant, with its own resources or with the involvement of other organisations.

The executive order establishes that any nuclear energy use permits (licenses) issued with respect to the Zaporozhye Nuclear Power Plant before September 30, 2022, continue to be effective until new permits (licenses) are issued in accordance with the laws of the Russian Federation that regulate the use of nuclear energy. The same applies to nuclear energy work permits issued to employees at the Zaporozhye Nuclear Power Plant before September 30, 2022.

Relevant instructions have been given to the Government of the Russian Federation. In particular, the Government was instructed to ensure the acceptance into federal ownership of the nuclear power facilities at the Zaporozhye Nuclear Power Plant as well as other ancillary property necessary for its operation, as well as to take the required action to establish a federal state unitary enterprise, Zaporozhye NPP, in order to ensure the safety and security of the power plant’s nuclear energy facilities.

In addition, the Government was instructed to develop the specific regulations, effective until January 1, 2028, for the Operating Organisation of the Zaporozhye NPP joint-stock company’s use of financial, material and other resources necessary to ensure the safety of nuclear facilities, radiation sources, storage facilities for nuclear materials and radioactive substances, and radioactive waste storage facilities, and for the proper handling of nuclear materials and radioactive substances. Also, the Government is to determine, for the period until January 1, 2028, the specifics of the organisation and implementation of federal state oversight in the field of the use of nuclear energy and industrial safety in relation to the Zaporozhye Nuclear Power Plant.

The Government was also instructed to ensure the issuance of nuclear energy use permits (licenses) with respect to the Zaporozhye Nuclear Power Plant, and nuclear energy work permits to employees at the Zaporozhye Nuclear Power Plant

This executive order shall enter into force on the date of signing.
