Request to verify compliance of Agreement on Accession of Republic of Crimea to the Russian Federation with the Constitution

Vladimir Putin submitted a request to the Constitutional Court of the Russian Federation on verifying the compliance of the Agreement between the Russian Federation and the Republic of Crimea on the Accession of the Republic of Crimea to the Russian Federation and the Formation of New Federal Constituent Entities within Russia with the Constitution.

The full text of the document reads as follows:

In accordance with Paragraph G in Part 2 of Article 125 of the Constitution of the Russian Federation and Article 88 of the Federal Constitutional Law No. 1-FKZ of July 21, 1994 On the Constitutional Court of the Russian Federation, I hereby request a verification of the compliance of the Agreement between the Russian Federation and the Republic of Crimea on the Accession of the Republic of Crimea to the Russian Federation and the Formation of New Federal Constituent Entities within Russia with the Constitution of the Russian Federation.

The Agreement between the Russian Federation and the Republic of Crimea on the Accession of the Republic of Crimea to the Russian Federation and the Formation of a New Federal Constituent Entity within Russia was made between the President of the Russian Federation and the authorised representatives of the Republic of Crimea and the city of Sevastopol on March 18, 2014 and published in Rossiyskaya Gazeta on March 19, 2014.

The legal basis for the Agreement is the following: Part 2 of Article 65 of the Constitution of the Russian Federation, in accordance with which accession to the Russian Federation and formation of a new federal constituent entity is carried out in accordance with the procedures established by Federal Constitutional Law; Point B in Article 86 of the Constitution of the Russian Federation, in accordance with which the President of the Russian Federation holds negotiations and signs international agreements for the Russian Federation; Chapters I and II of the Federal Constitutional Law No. 6-FKZ of December 17, 2001 On Procedures for Accession to the Russian Federation and Formation of a New Federal Constituent Entity within the Russian Federation.

The basis for signing the Agreement was the request from the State Council of the Republic of Crimea – the parliament of the Republic of Crimea and the Legislative Assembly of the city of Sevastopol – on the accession of the Republic of Crimea to the Russian Federation, including the city of Sevastopol, and the formation of new federal constituent entities within the Russian Federation. In accordance with the procedures established by said Federal Constitutional Law, the President of the Russian Federation informed the Federation Council of the Federal Assembly of the Russian Federation, the State Duma of the Federal Assembly of the Russian Federation and the Government of the Russian Federation of this fact. The requests were considered and the preparation of the Agreement was carried out in accordance with the Federal Constitutional Law On Procedures for Accession to the Russian Federation and Formation of a New Federal Constituent Entity within the Russian Federation and the Federal Law No. 101-FZ of July 15, 1995 On International Agreements of the Russian Federation.

In signing the Agreement, the requirements of the Constitution of the Russian Federation, the state interests of the Russian Federation, the principles of the federative structure of the Russian Federation, and the rights and freedoms of individuals and citizens are respected, as are the existing historical, economic and cultural ties between Russia and Crimea and the city of Sevastopol.

The Agreement contains provisions establishing the names and status of the new Russian federal constituent entities – the Republic of Crimea and the Federal City of Sevastopol – the applicability of the Russian Federation’s legislation in those territories, and the procedures for the acquisition of Russian citizenship by Ukrainian citizens and stateless persons. It also establishes a transitional period during which new government bodies are formed in the Republic of Crimea and the Federal City of Sevastopol. In accordance with the Agreement, Russian, Ukrainian, and Crimean-Tatar are the official state languages of the Republic of Crimea.

In accordance with Article 6 of the Federal Constitutional Law On Procedures for Accession to the Russian Federation and Formation of a New Federal Constituent Entity within the Russian Federation and Article 15 of the Federal Law On International Agreements of the Russian Federation, the Agreement is subject to ratification.

I hereby ask the Constitutional Court of the Russian Federation, taking into account the current situation in Crimea and Sevastopol, to consider this request without holding public hearings, since the Agreement between the Russian Federation and the Republic of Crimea on the Accession of the Republic of Crimea to the Russian Federation and the Formation of New Federal Constituent Entities within Russia is intended to observe the Russian Federation’s state interests, the rights and freedoms of the residents of Crimea and Sevastopol as well as citizens of the Russian Federation, and to strengthen the existing economic and cultural ties between Russia and Crimea and Sevastopol.
