The protocol was signed in Moscow on December 12, 2008, and establishes a rule whereby tariff preferences on imports to the common customs area that do not fall under the provisions of articles 5 and 6 of the Agreement on Common Customs Tariff Regulation of January 25, 2008 are applied solely on the basis of a decision by the Customs Union Commission, which carries out comparative analysis of the customs union participant countries’ legislation governing tariff preferences.
